2. Consumer Guarantees

Under the ACL, our products come with guarantees that they:

  • Are of acceptable quality
  • Are fit for their disclosed purpose

  • Is substantially unfit for normal use
  • Would not have been purchased by a reasonable consumer had they known of the issue

By purchasing a motorised product, you acknowledge:

  • Motorised ride-ons carry inherent risks
  • Adult supervision is required at all times unless otherwise stated
  • Products must only be used in accordance with instructions
  • Products must not be used on public roads unless legally permitted
  • Helmets and safety gear are strongly recommended

We are not liable for injury or damage arising from:

  • Reckless use
  • Unsupervised use
  • Use outside manufacturer guidelines
  • Use on unsuitable terrain

6. Assembly Responsibility

Many motorised products require partial or full assembly.

We are not responsible for:

  • Incorrect assembly
  • Incorrect wiring connections
  • Improper battery installation
  • Loose bolts or fittings not checked prior to first use
  • Failure to conduct safety checks before use

It is the customer’s responsibility to:

  • Follow instructions carefully
  • Perform safety checks prior to each use
  • Ensure brakes, steering, throttle and wiring are secure

Improper assembly voids warranty where the fault is caused by that assembly.

7. Battery & Electrical Systems (Enhanced Terms)

Motorised ride-ons contain electrical systems that require proper care.

7.1 Battery Care Requirements

Batteries must:

  • Be charged before first use
  • Not be left fully discharged
  • Be charged at least once every 30 days when not in use
  • Be stored in a dry, temperature-controlled environment

Battery damage caused by:

  • Overcharging
  • Undercharging
  • Water exposure
  • Incorrect charger use
  • Use of third-party chargers
  • Physical impact

is not considered a manufacturing fault.

7.2 Normal Battery Degradation

Battery capacity naturally reduces over time and with usage cycles.
This is normal wear and not a defect.

8. Water, Weather & Terrain Limitations

Unless expressly stated as waterproof or off-road rated:

Products must not be used in:

  • Rain
  • Wet grass
  • Puddles
  • Sand
  • Mud
  • Saltwater environments

Water ingress into motors, controllers, switches, batteries, or wiring voids warranty unless the product is explicitly rated for such exposure.

9. Weight Limits & Overloading

Each motorised product has a maximum rider weight.

Exceeding stated limits may result in:

  • Motor damage
  • Gearbox failure
  • Frame stress
  • Battery strain

Damage caused by exceeding weight limits is not covered under warranty.

10. Commercial & Hire Use Exclusion

Products sold by RideOns.com.au are intended for domestic recreational use only unless explicitly stated otherwise.

Warranty is void where products are used for:

  • Hire businesses
  • Commercial events
  • Rental operations
  • School fleet programs
  • Promotional activities

Commercial use significantly accelerates wear and is not covered.

11. Modifications & Aftermarket Parts

Warranty is void if:

  • The motor is upgraded
  • The battery voltage is modified
  • Controllers are replaced with non-approved units
  • Speed limiters are removed
  • Aftermarket parts are installed
  • Structural alterations are made

Any modification is undertaken at the customer’s own risk.

PART E – DAMAGE, FAULTS & CLAIMS

12. Freight Damage

You must notify us within 48 hours of delivery if the product is damaged in transit.

Claims must include:

  • Photos of outer packaging
  • Photos of damage
  • Photos of shipping label
  • Clear description

Failure to report within 48 hours may affect freight claim eligibility.

13. Fault Claims & Evidence Requirements

To assess a motorised product fault, we may require:

  • Photos
  • Video demonstrating the issue
  • Charger output readings
  • Battery voltage readings
  • Serial numbers
  • Diagnostic steps to be performed

We may provide troubleshooting steps prior to approving return/replacement.

14. Inspection & Testing

Returned products will be tested.

If no fault is found, or damage is due to misuse:

  • The customer is responsible for return freight
  • A testing or handling fee may apply
  • Re-delivery costs must be paid before dispatch

PART F – LIMITATION OF LIABILITY

15. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential losses
  • We are not liable for loss of enjoyment or inconvenience
  • We are not liable for personal injury arising from misuse
  • We are not liable for damage caused by third-party modifications

Nothing in this clause limits your rights under ACL.

PART G – REFUNDS

16. Refund Processing

Approved refunds will:

  • Be processed to the original payment method
  • Exclude shipping costs unless required by law
  • Exclude payment gateway fees where permitted
